Terms of Service

Welcome to MakeMyOC. These Terms of Service govern your access to and use of our website and AI-powered original character creation service. By using MakeMyOC, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using MakeMyOC, you confirm that you are at least 18 years old and agree to comply with these Terms of Service. If you do not agree, please do not use our service.

2. Description of Service

2.1 What We Provide

MakeMyOC is a digital software-as-a-service platform for creating original-character images with AI and previewing planned video-generation capabilities. Users can enter text prompts, choose supported settings, and, where available, upload a reference image. GPT Image 2 is currently available for image generation. Nano Banana and Nano Banana Pro appear in the model selector as Coming Soon previews and do not generate content yet. Video generation is currently a Coming Soon waitlist feature; its planned models are Seedance 2.0 Fast and Seedance 2.0.

2.2 Digital Service and Credits

The service is delivered online. Available image generation may require credits, and the applicable credit amount is shown in the product interface before generation. A Coming Soon model does not consume credits or create generated content.

2.3 Third-Party AI Models

The service depends on third-party AI models. Model availability, performance, and output quality may be affected by the model developers' services. We may update available models and will update this disclosure when a material change affects users.

3. User Accounts

  • You may sign in using Google authentication.
  • You are responsible for maintaining the security of your account.
  • You must not share your account with others or use another person's account.
  • We reserve the right to suspend or terminate accounts that violate these terms.

4. Credits and Payments

  • Character generation requires credits. New users receive a limited number of free credits.
  • Additional credits can be purchased through available checkout methods, which may be provided by Waffo Pancake, Stripe, or PayPal.
  • All purchases are final. Refunds are handled on a case-by-case basis.
  • If an AI generation fails, no credits will be deducted from your account.
  • We reserve the right to modify pricing and credit amounts at any time.

5. Content and Intellectual Property

5.1 Your Content

  • You retain ownership of the text prompts you provide.
  • Images generated through our service are available for your personal and commercial use.
  • By making your creations public, you grant MakeMyOC a non-exclusive license to display them in the community gallery.

5.2 Prohibited Content

You agree not to use our service to generate:

  • Content that is illegal, harmful, or violates the rights of others.
  • Content depicting real individuals without their consent.
  • Explicit sexual content involving minors.
  • Content that promotes violence, hatred, or discrimination.
  • Content that infringes on copyrights, trademarks, or other intellectual property rights.

We reserve the right to remove any content that violates these guidelines and to suspend accounts that repeatedly violate them.

5.3 Our Content

All website design, logos, text, and software are the property of MakeMyOC and are protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content without permission.

6. Acceptable Use

You agree not to:

  • Use automated tools, bots, or scripts to access our service.
  • Attempt to reverse-engineer or extract our AI models.
  • Interfere with or disrupt the service or its infrastructure.
  • Use the service for any unlawful purpose.
  • Resell or redistribute access to our service.

7. AI-Generated Content Disclaimer

  • AI-generated images may not always match your expectations.
  • We do not guarantee specific results from any prompt.
  • Generated content may occasionally contain unexpected elements due to the nature of AI technology.
  • We are not responsible for how you use the generated images.

8. Privacy

Your use of MakeMyOC is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.

9. Limitation of Liability

To the maximum extent permitted by law:

  • MakeMyOC is provided "as is" without warranties of any kind.
  • We are not liable for any indirect, incidental, or consequential damages arising from your use of the service.
  • Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless MakeMyOC and its operators from any claims, damages, or expenses arising from your use of the service or violation of these terms.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the service at any time without prior notice. We are not liable for any modification, suspension, or discontinuation of the service.

12. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the service after changes constitutes acceptance of the new terms.

13. Governing Law

These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms shall be resolved through good-faith negotiation first.

15. AI Models and Providers

MakeMyOC currently uses GPT Image 2, developed by OpenAI, for image generation. Nano Banana and Nano Banana Pro, developed by Google, are displayed as Coming Soon and are not yet available for generation. Video generation is currently a Coming Soon waitlist feature; its planned models are Seedance 2.0 Fast and Seedance 2.0, developed by ByteDance. We may update models as the service evolves and will update this disclosure when a material change affects users.

16. AIGC Acceptable Use and Prohibited NSFW Content

You must not use MakeMyOC to create, upload, request, publish, or share pornography, sexually explicit content, adult sexual content, graphic nudity, sexual services, fetish content, or any other NSFW content. Sexual content involving minors, sexual exploitation, or non-consensual intimate imagery is strictly prohibited and may be reported to the appropriate authorities. The prohibitions in Section 5 continue to apply in addition to these rules.

17. Reporting Prohibited Content

Report suspected prohibited or unlawful content by emailing [email protected]. Include the page URL or content identifier, a short description of the issue, and any relevant screenshot. Use the subject line "Content Safety Report" when possible. We protect reporter information to the extent reasonably possible and prohibit malicious or knowingly false reports.

18. Content Moderation and Enforcement

MakeMyOC uses layered safeguards that may include pre-generation prompt and keyword checks, model-provider safety controls, automated review of generated outputs where applicable, and human review of reported or publicly displayed content. Reports are received, triaged by severity, reviewed using available technical evidence and human judgment, and resolved through measures such as blocking a generation, preventing public display, hiding or removing content, restricting features, suspending or terminating accounts, and preserving or reporting evidence when required by law. Urgent child-safety and credible imminent-harm reports receive priority. Where appropriate, we notify the reporter or affected user of the outcome. Appeals may be sent to [email protected].

19. Payment Processors

Depending on the checkout method, payments may be processed by Waffo Pancake, Stripe, or PayPal. MakeMyOC does not store full payment card numbers on its servers.
